There is no abandonment when the parents are too old to adequately fulfill their parental and educational tasks, not even when other vicarious persons, such grandparents who are willing and capable to take care of the grandchildren, exist. The decisions that are being commented change the concept of abandonment required by the law on adoption and introduce different and secondary evaluations with respect to the abovementioned requisite.
