The Italian Court of Cassation defines the elements necessary to prove the relationship of two individuals outside marriage. In the specific case of the wrongful death, the surviving partner is entitled to claim civil damages for the loss only if the existence of the relationship itself can be proven. Cohabitation per se is not, according to the Court of Cassation, an essential part of a relationship, but rather only a presumptive factor, requiring for it to be appreciated alongside other pieces of evidence. Hence, the fact that two individuals may not live together does not prevent the surviving one to claim compensation against the person liable for their partner’s death.
