Legato di usufrutto su cosa parzialmente altrui, comunione indivisa e rilevanza della volontà testamentaria

The Court, by it’s judgment, declares that the bequest of usufruct, on a partially other’s thing, is void, if this thing belong to a wide, undivided, joint tenancy.
As it will be shown, the Court’s statement can’t be corroborate, especially thanks to the reasoning behind the articles 652 and 651, clause 1, civil Code, the joint tenancy’s legal nature and the right of the interest proprietary in question. It’s claimed that the bequest is void, due to the principles of the will interpretation, and therefore for the testator’s will, together with the mentioned articles 652 and 651, clause 1, civil Code.
