This article aims to analyse the legislation on the protection of foreign children, which has been the subject of numerous debates in Western countries for several years. The increase in migration flows, mainly from Central-Eastern Europe and currently the migration wave from North Africa, have led the European and national legislators to implement policies and measures aimed at ensuring border security and preventing uncontrolled entry, without prejudice to the recognition of the right to asylum.
