The article highlights that in modern times the «remoteness» of a parent, provided for in Article 317 of the Italian Civil Code as a possible cause of impediment to exercise parental authority, can constitute an insurmountable obstacle only in exceptional cases. The evolution of science in fact allows even the (very) distant parent to participate in decision-making processes in the interest of the children. The removal of the reference to «remoteness» in the text of the rule is therefore desired, especially since the sole exercise of parental authority by the other spouse does not take place on the basis of a court decision.
