The paper analyses the decision no. 68/2025 of Constitutional Court, which recognizes parental status for the intended mother in cases of heterologous medically assisted procreation by female same-sex couples. The Court identifies consent to human fertilisation practice as the source of parental responsibility, according to the principle of ‘consensus facit filios’, and emphasizes the best interests of the child in the full and immediate recognition of emotional ties. The decision, highlighting the inadequacy of adoption in particular cases and filling a legislative gap, marks an evolution towards models of intentional parenthood independent of biological link.. . .
