06.11.2025 An overview of the main European experiences regarding cohabitation reveals a fragmented landscape, due to the different solutions adopted by each national legal system. The common denominator, however, is the recognition of family life arrangements that develop outside of marriage, regardless of the partners’ sexual orientation. Within the European framework – regardless of the provisions set out in Articles 8 and 14 of the European Convention on Human Rights (ECHR)[1] – the so-called “de facto family” received its first significant recognition in the Charter of Fundamental Rights of the European Union adopted on 7 December 2000.
