The evolution of family law – both in its legislative and interpretive dimensions – marked by the progressive democratization of family relations, has led to the emancipation of women from the position of subordination to which the law had relegated them, particularly within the family community. This process, however, has not yet reached completion, and it is within this broader trajectory that the new procedural provisions on domestic or gender-based violence must also be situated. Such provisions may serve, among other things, to revitalize pre-existing civil-law remedies, such as judicial separation with attribution of fault. Sommario: 1.
